Regulations of the Park & Ride car parks in the capital city of Warsaw

§ 1

  1. These Regulations govern the use of Park & Ride car parks in capital city of Warsaw, hereinafter referred to as the „Car Parks”, administered by the capital city of Warsaw with the help of the budget unit of the capital city of Warsaw under the name of the Public Transport Authority (ZTM) – hereinafter referred to as the „Administrator”.
  2. The Car Park is a paid, public and unguarded car park, open 7 days a week, under the conditions specified in § 4.
  3. In justified cases, the Administrator may decide to:
    1. open the Car Park or its part at hours other than those specified in § 4(1);
    2. periodically exclude the Car Park or part thereof from use.

§ 2

The terms used in these Regulations have the following meanings:

  1. Vehicle – a passenger car, within the meaning of the Act of 20 June 1997, Road Traffic Law (Journal of Laws of 2023, item 1047 as amended[1] – hereinafter referred to “Road Traffic Law”) including an electric, hybrid Vehicle;
  2. of 11 January 2018 on electromobility and alternative fuels (Journal of Laws of 2023, items 875, 1394, 1506 and 1681);
  3. Hybrid vehicle – Vehicle: within the meaning of the Act of 11 January 2018 on electromobility and alternative fuels;
  4. User – a natural person actually using the Car Park (a person driving this: Vehicle, motorcycle, bicycle, moped, scooter) or the owner of a Vehicle, motorcycle, bicycle, moped, scooter. If it is impossible to determine the identity of a person driving the Vehicle, motorcycle, bicycle, moped, scooter, the user is deemed to be, in particular, the owner of the Vehicle, motorcycle, bicycle, moped, scooter;
  5. Parking space – a separate area in the Car Park intended for parking the Vehicle, including motorcycles and mopeds.

§ 3

  1. The Car Park is intended for Vehicles, motorcycles, bicycles, mopeds, scooters and persons using the infrastructure of the Car Park.
  2. Vehicles not indicated in paragraph 1 are not allowed to be parked in the Car Park, subject to paragraph 6.
  3. Upon entering the Car Park, the Car Park User concludes a parking space rental agreement with the Administrator under the terms and conditions laid down in these Regulations.
  4. Upon entering the Car Park, the Car Park User accepts the conditions of these Regulations and undertakes to comply with its provisions.
  5. The parking space rental agreement expires at the moment of leaving the Car Park.
  6. The Administrator may allow vehicles other than those mentioned in paragraph 1 to use the Car Park.
  7. When using the Car Park, the application of the provision of Article 674 of the Act of 23 April 1964 Civil Code (Journal of Laws of 2023, items 1610, 1615, 1890 and 1933) is excluded.

§ 4

  1. Vehicles are allowed to be parked in the Car Park from 4:30 to 2:30
  2. From 2:31 to 4:29, it is prohibited to park Vehicles in the Car Park.
  3. The prohibition referred to in paragraph 2 does not apply:
    1. on Saturdays from 2:31 to 4:29 on Mondays;
    2. in the situations referred to in § 1(3).
  4. The prohibition referred to in paragraph 2 does not apply to:
    1. bicycles, mopeds, motorcycles and scooters;
    2. Vehicles of the Administrator, of the Car Park staff when performing maintenance activities and vehicles of security services;
    3. Tenants of parking space pursuant to separate civil law agreements.

§ 5

  1. The rules laid down in the Road Traffic Law are in force in the Car Park.
  2. It is prohibited to park the Vehicle outside the designated space.
  3. Motorcycles, mopeds, bicycles and scooters should be parked in a manner that does not impede the use of the Car Park by other Users.
  4. The User, on their own, protects their Vehicle, motorcycle, bicycle, moped, scooter against theft or damage, in particular, by turning off the ignition, lights, closing windows, doors and trunk and immobilising.
  5. Parking spaces intended for charging electric, hybrid Vehicles may be used only by the Users of these vehicles. Failure to comply with the requirement is treated as parking the Vehicle outside the designated place.

§ 6

  1. The User is obliged to pay fees in the amounts specified in the price list for the use of Park & Ride car parks in the capital city of Warsaw, constituting an annex to these Regulations, whereby the parking fee starts being charged after 20 minutes from the moment the Vehicle enters the Car Park, during the Car Park opening hours.
  2. Charging of electric, hybrid Vehicles is payable in the amount specified in the price list referred to in paragraph 1.
  3. No fee is charged for:
    1. parking bicycles, mopeds, motorcycles and scooters;
    2. parking the Vehicles of the Administrator, of the Car Park staff in performing maintenance activities and vehicles of security services;
    3. charging the electric, hybrid Vehicles of the Administrator.
  4. The following Vehicle Users are exempt from the fee for renting a parking space:
    1. holders of the following ticket: short-term, long-term, valid in zones 1, 2 or 1 and 2, giving them the right to use local public transport in the capital city of Warsaw, which has been validated and is still valid;
    2. having the right to travel free of charge by local public transport organised by the capital city of Warsaw pursuant to separate regulations.
  5. The compliance with the conditions of the parking space rental agreement is checked at the exit from the Car Park in the control zone. The method of checking the rights is determined by the Administrator.

§ 7

  1. It is prohibited to use the Car Park in contradiction with its intended purpose, including in violation of occupational health and safety regulations and to behave in a manner prohibited pursuant to separate regulations.
  2. Should the User violate the provisions of these Regulations, the Administrator may apply measures necessary to restore the condition compliant with the Regulations, including by removing the Vehicle, motorcycle, moped, bicycle, scooter from the Car Park.

Applies to selected Car Parks where an automated parking management system is installed. A car park ticket is understood as a carrier taken from the terminal by the User entering the Car Park, based on which fees and penalties for the use of the Car Park are settled.
